Welcome to Harmona. These Terms of Service ("Terms") govern your access to and use of the Harmona platform, website, and services (collectively, the "Service") operated by Harmona ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. You must be at least 18 years of age to use the Service. By using Harmona, you represent that you meet this requirement.
2. Description of Service
Harmona is a B2B SaaS platform designed to help organizations measure and improve employee wellbeing. The Service includes: - Employee wellbeing surveys and assessments using scientifically validated instruments - Burnout detection and early warning analytics - Employee engagement tracking and reporting - MBTI-based personality assessments for team dynamics - Analytics dashboards with organizational and departmental insights - Bilingual support (English and Arabic) We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.
3. User Accounts & Responsibilities
To use the Service, your organization must register an account. You are responsible for: - Providing accurate and complete registration information - Maintaining the confidentiality of your account credentials - All activities that occur under your account - Ensuring that your use of the Service complies with all applicable laws and regulations - Obtaining appropriate consent from employees before enrolling them in assessments You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.
4. Subscription & Billing
Harmona offers multiple subscription tiers, including a free plan with limited features. Paid subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. All payments are processed through Lemon Squeezy, our Merchant of Record. By subscribing to a paid plan, you agree to Lemon Squeezy's terms of service in addition to these Terms. - Prices are listed in USD and SAR and are subject to change with 30 days' prior notice - Subscriptions automatically renew unless cancelled before the renewal date - Upgrades take effect immediately; downgrades take effect at the next billing cycle - All fees are exclusive of applicable taxes, which will be added where required by law For details on refunds, please refer to our Refund Policy.
5. Data Privacy & Security
Protecting your data is fundamental to our Service. 6. Intellectual Property
All content, features, functionality, software, designs, and trademarks of the Service are owned by Harmona and are protected by international intellectual property laws. You retain ownership of all data you submit to the Service. By using Harmona, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Harmona and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service's fitness for a particular purpose, accuracy, or reliability.
8. Termination
Either party may terminate the subscription at any time: - You may cancel your subscription through your account settings or by contacting support@harmona.app - We may suspend or terminate your access if you violate these Terms, fail to pay fees, or engage in conduct that harms other users or the Service - Upon termination, your right to use the Service ceases immediately - We will retain your data for 30 days after termination, during which you may request an export. After this period, your data will be permanently deleted in accordance with our data retention policy.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify you of material changes by email or through a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
